General business conditions
●1.   Der Auftraggeber (Mieter, Vermieter, Käufer, Verkäufer usw..) verpflichtet sich, alle Daten wahrheitsgemäß zur Verfügung zu stellen und befreit uns hinsichtlich der Weitergabe von datenschutzrechtlichen Beschränkungen. Der Auftraggeber haftet bei falschen Angaben für die bei uns und anderen Vertragspartnern entstandenen Schäden.
 
●2.    Alle Angebote und sonstigen Mitteilungen sind nur für den Adressaten bestimmt und müssen vertraulich behandelt werden. Die Sämtliche Angebote sind freibleibend und basieren auf den uns erteilten Informationen. Wir bemühen uns, möglichst richtige und vollständige Angaben zu machen; unsere Haftung für Richtig- und Vollständigkeit beschränkt sich jedoch auf Vorsatz und grobe Fahrlässigkeit.
 
3.   Weitergabe von Angeboten und / oder sonstigen Mitteilungen an Dritte ist nur mit unserer ausdrücklichen Zustimmung gestattet. Dies gilt auch für die Verwendung bzw. das Kopieren von Exposétexten. Erfolgt gleichwohl eine Weitergabe an Dritte und kommt dadurch ein Vertrag zustande, so kann uns der Adressat – unbeschadet weiterer Schadensersatzansprüche – Schadenersatz in Höhe der vereinbarten Provision schulden.
4.    Ist dem Adressaten eine nachgewiesene Vertragsabschlussgelegenheit   bekannt, hat er uns dies unter Offenlegung der Informationsstelle unverzüglich mitzuteilen.
 
●5.   Wird ein angebotenes Objekt später durch Dritte erneut angeboten, erlischt dadurch unser Provisionsanspruch nicht. Um eine doppelte Provisionszahlung zu vermeiden, wird empfohlen, den nachfolgenden Anbietern die Vorkenntnis schriftlich mitzuteilen und auf deren Maklerdienste zu verzichten.
 
●6.   Der Auftraggeber wird uns unverzüglich von einem Vertragsabschluss    unterrichten; er ist verpflichtet, ihm eine Vertragsabschrift zu übersenden.
 
7.   Wir sind berechtigt, auch für den anderen Vertragspartner entgeltlich oder unentgeltlich tätig zu werden. In Fällen der Doppeltätigkeit werden wir den Grundsatz strenger Unparteilichkeit beachten. Zwischenverkauf und –Vermietung bleiben vorbehalten.
 
●8.   Kommt es aufgrund unserer Tätigkeit zum Abschluss eines Vertrages (z.B. Kauf,      Miete, Pacht), wird die ortsübliche Provision in Höhe von 3 % des Kaufpreises        (zzgl. 19 % MwSt.) für den Käufer
   3 % (zzgl. 19 % MwSt.) des kapitalisierten Erbbauzinses für den Erbbaurechts-        nehmer eines von uns nachgewiesenen oder vermittelten Objekts  geschul-            det, sofern keine abweichende Vereinbarung getroffen ist. Dies gilt auch
          dann, wenn die Bedingungen des Vertrages von den in dem überlassenen
          Angebot genannten Konditionen abweichen, oder statt des ursprünglich                  beabsichtigten Geschäfts ein anderes zustande kommt. Ein Provi-
    sionsanspruch entsteht auch, wenn der Vertrag erst nach Vertragsbeendigung      abgeschlossen wird. Der Provisionsanspruch ist mit dem Vertragsabschluss            über das nachgewiesene bzw. ermittelte Objekt fällig. Auf unser Verlan-
    gen übergeben Sie uns eine Vertragskopie.
 
9.    Sollte eine Geschäftsbedingung unwirksam sein oder werden, bleiben die               übrigen Bedingungen voll wirksam. An die Stelle eventuell unwirksamer                 oder lückenhafter bzw. richtiger Bestimmungen treten die gesetzlichen                    Bestimmungen.
 
10.   Erfüllungsort und Gerichtsstand im Verkehr mit Kaufleuten ist Köln
 
11.    Datenerhebung, -verarbeitung und –Nutzung erfolgen nur zur Ausführung             Ihres Auftrages. Es erfolgt keine Weiterleitung an Dritte.
 
12.    Die Pflichten nach dem Geldwäschegesetz (GWG): Der Gesetzgeber schreibt         in der Neufassung des Geldwäschegesetzes vom 26.06.2017 vor, die                        Vertragspartner bei ernsthaftem Interesse zu identifizieren. Immobilien-
      makler haben diese Sorgfaltspflicht einzuhalten. Die Dienstleistungen, die zur        reinen Information in Anspruch genommen werden – wie z.B. der Versand 
             von Exposés oder die Teilnahme an einer Besichtigung, verpflichten den
             Makler gem. GWG nicht, die Identifizierung vorzunehmen. Das Recht zur                Identifizierung durch den Makler bleibt dennoch bestehen. Der Makler
             ist verpflichtet eine Kopie der Ausweispapiere zur Identifizierung                               anzufertigen. Darüber hinaus hat der Makler zu klären, ob der
             Kunde im eigenen wirtschaftlichen Interesse handelt, oder für einen Dritten.         Festgehalten werden muss auch, ob es sich bei dem Vertragspartner und ggf.         wirtschaftlich Berechtigten um eine politische exponierte Person
      (PEP)
 handelt. Als Kunde sind Sie verpflichtet, dem Immobilienmakler den            Ausweis vorzulegen und die entsprechenden Auskünfte zu erteilen
            (§ 4 Abs.6 GWG). Bitte helfen Sie uns dabei, die gesetzlichen Pflichten zu                erfüllen und erteilen Sie uns die erforderlichen Auskünfte.

You may, but do not have to, use the enclosed sample cancellation form.

To ensure the cancellation period is upheld, it is sufficient to inform us of your decision to exercise the right of cancellation before the cancellation period has elapsed.

Results of cancellation
If you cancel this contract, we are obliged to reimburse all payments that we have received from you, including delivery costs (excluding additional costs which arose from your selection of a delivery method other than the one we offered as the cheapest standard delivery option) immediately, and within a maximum of 14 days after we receive notice of your decision to cancel this contract. We will use the same payment method for reimbursement that you employed for the original transaction, unless we have expressly agreed upon another method; under no circumstances will any charges arise from this reimbursement.

If you requested for the service to start within the cancellation period, you are obliged to pay us an appropriate sum, which corresponds to the proportion of the services already provided up to the point at which you inform us of the decision to exercise the right to cancel with regard to this contract, in comparison with the overall scope of the services agreed upon in the contract.
